Our apologies for the delay in providing this update. On September 1, 2026, Justice Hardwick dismissed our anti-SLAPP application to have Tyson Cook’s (aka drag queen Freida Whales) defamation lawsuit thrown out. After carefully reviewing the decision with our lawyer, Action4Canada filed an appeal to the BC Court of Appeal on Tuesday, September 29, 2026.

This is a critically important case in protecting freedom of speech and expression, the identity of women, and the innocence of our children. Canadians must be able to raise concerns about children’s exposure to inappropriate adult content and defend their position without being silenced by costly litigation.

Action4Canada firmly rejects Mr Cook’s allegations of defamation. Our position is that his claim misrepresents our legitimate concerns and uses the courts to punish us for bringing those concerns to public attention. Defending this case has already consumed substantial time, money and resources. Mr Cook has retained Norton Rose Fulbright, a major law firm with offices worldwide. We need your support to continue our defence and pursue this appeal.

The consequences of this case reach beyond Action4Canada. When the cost of defending public-interest speech becomes a means of silencing it, everyone’s freedom is threatened. We remain committed to defending our right to speak openly, challenge inappropriate content and advocate for children.

Action4Canada strongly believes that it is completely inappropriate for Mr Cook to be hosting and performing at an adult drag queen show with mature content whilst any minor is present.

Brief History of this Case

In case you haven’t been following this case, here is a brief overview. Tyson Cook, also known as drag performer Freida Whales, is publicly promoted by the media and supported by the local government in Kelowna, BC. In addition to performing drag queen story hours for children in local libraries, Cook has produced disturbing online content depicting murders, cannibalism and Satanic-like rituals, along with sexually vulgar and profane social media posts. This content was publicly available and easily accessible to children. After learning of this, we were deeply concerned to discover that Mr Cook was also working directly with vulnerable youth as an Education Assistant in the Kelowna School District and with autistic children through AutismBC. In January 2023, we requested that the school board reassess his suitability as an EA, created a petition and posted the information publicly. Nearly two years later, Mr Cook filed a defamation claim against Action4Canada, even though we had not spoken about him for nearly two years.
