What does a judge promise when taking the Oath of Office and Oath of Allegiance—and what limits the power exercised from the bench?
This week on Empower Hour, David Lindsay will present on judicial oaths, the duties entrusted to judges, and the constitutional principles that govern their decisions. We will ask whether judges’ powers are unlimited, whether the Charter and the Constitution Acts of 1867 and 1982 tell the whole story, and how the Crown and the Coronation Oath fit into Canada’s constitutional history.
These questions matter whenever Canadians turn to the courts for justice. A judicial oath is a solemn commitment to carry out the powers and duties of office faithfully. The Christian Biblical principles that shaped our legal inheritance must remain central to that commitment. David will discuss what the oath requires of judges and how judicial independence works alongside accountability.

What happened in court on September 24 was a travesty of justice—and it shows why judicial oaths matter. After Rocco Galati argued against the defendants’ second application to strike our COVID-19 claim, Justice Gordon C Weatherill took a 15-minute break, heard a brief reply from the defendants, and then immediately read an 11½-minute ruling striking our case in its entirety. Those prepared reasons could not have been written during that brief break. Did he draft his judgment before he heard our lawyer’s submissions? The ruling gave no meaningful answer to the Supreme Court authorities and arguments Mr Galati presented. He dismissed Mr Galati’s submissions as “general, vague, and superficial protests” and portrayed Action4Canada’s case as conspiratorial, a “crusade” tied to “Christian nationalism,” and said the grievances raised had no place in court.
